What: Milan shoplifted and was arrested, later died due to a lack of oxygen to the brain.

Why: Arrested because he shoplifted.
How: Stuffed two seaters down his pant legs.

    A 19 year old shoplifter, Timothy Milan, shoplifted from Panzars Department Store last Saturday by stuffing two seaters down his pant legs, he was later arrested and passed away due to a lack of oxygen in his brain.

    "We saw him start running and the guard was right behind him," eye witness Sherry Carter said.

    When the guard saw Milan stuffing two seaters in his pant legs, the guard began to chase Milan. He then caught up with Milan and one of the bystanders put Milan in a headlock.

    "We went outside to see what was going to happen and we saw the boy get dragged to the ground," Carter said.

    The bystander  was fighting violently, punching and kicking at his captors and even trying to bite them.


    "We are sorry for the death of the young man, it was never our intentions for these kinds of things to happen," Panzer's Department Store manger Paula Smith said.

    Police said they were simply trying to restrain him and trying to help capture a suspected criminal.

    "It was a case of excusable homicide,"Police spokesman Michael Williams said.

     An autopsy conducted to determine the cause of death revealed that Milan died due to a lack of oxygen to the brain.

   "The gentleman who held onto Milan was just being a good citizen." Williams said.

    The police said the bystanders did not mean to injure Milan or to kill him.

   "Our lawyers are already filing papers and we encourage the courts to revisit this ruling from a criminal perspective," Timothy Milan's father, Eric Milan.

Police today said they do not plan to charge anyone involved in the case with a crime. 

 "My wife and I are just in ruins over this. He was our only child and he had never had problems with the law."
